1. Introduction

These Terms & Conditions ("Terms") govern your use of the FindU mobile application, website, and related services (collectively, the "Service") provided by FindU, LLC ("FindU," "we," "us," or "our"). By using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

Important Disclaimer:

FindU is an informational and exploratory tool that helps students discover colleges based on personal data, preferences, and interests. While we provide tools to support your college search, we do not guarantee admission, financial aid, scholarships, or any specific college outcomes. Decisions made by institutions or third parties are independent of FindU and beyond our control.

2. Eligibility and Account Registration

2.1 Eligibility

FindU is designed for high school students, typically between the ages of 14–18. You must be at least 13 years old to use the Service. Users under the age of 13 are strictly prohibited from creating an account.

If you are between 13 and 18 years old, you confirm that you have informed your parent or guardian about your use of the Service. While parental consent is not required by FindU, we encourage involving a trusted adult.

2.2 Account Registration

To access the Service, you must create an account by providing accurate, current, and complete information.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. If you believe your account has been compromised, please notify us immediately.

3. Use of the Service

3.1 Purpose

FindU provides a personalized platform for exploring colleges and connecting with educational institutions based on your academic profile, preferences, and interactions.

You agree to use the Service only for personal, non-commercial purposes and in accordance with all applicable laws.

3.2 College Matching and Data Sharing

You can choose your level of visibility to colleges through the following College Contact Preferences:

  • Colleges can connect with me
  • No colleges can connect with me

By opting in to share your profile, you authorize FindU to share your information with partner colleges and relevant revenue partners, including advertisers. You may update your sharing preferences at any time in the app settings. Data already shared may not be retracted from third parties.

3.3 Monetization

FindU generates revenue by selling or licensing data to partner colleges, advertisers, and business partners. This may include both identifiable and aggregated user data, subject to your consent preferences and in accordance with our Privacy Policy.

3.4 Prohibited Conduct

You agree not to:

  • Violate any applicable law or regulation
  • Impersonate another person or entity
  • Access or attempt to access another user's data without authorization
  • Disrupt or interfere with the Service (e.g., via hacking, scraping, or spreading malware)
  • Submit unlawful, obscene, abusive, or otherwise harmful content

FindU reserves the right to suspend or terminate any user engaging in such activity.

4. Intellectual Property

4.1 Ownership

All content made available through the Service—including text, graphics, logos, software, and user interface components—is owned by FindU or its licensors and is protected by copyright and other intellectual property laws.

4.2 Limited License

FindU grants you a personal, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

You may not reproduce, copy, modify, distribute, or reverse engineer any part of the Service without our prior written consent.

4.3 User Content

You retain ownership of the information and content you provide (e.g., profile details). However, by submitting such content, you grant FindU a worldwide, royalty-free license to use, display, and share that information as necessary to provide the Service, including sharing with colleges when you have consented to do so.

5. Fees and Payment

The core features of the Service are provided free of charge for students.

If FindU introduces premium services in the future, pricing information will be clearly disclosed, and your consent will be obtained before any charges are made.

6. Disclaimers and Limitation of Liability

6.1 No Warranty

The Service is provided "as is" and "as available." FindU makes no representations or warranties regarding the accuracy, completeness, or reliability of college recommendations or any other content.

We do not guarantee admission to any college or the outcome of any application process.

6.2 Limitation of Liability

To the fullest extent permitted by law, FindU and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

In no event shall FindU's total liability to you exceed $100 USD or, if applicable, the amount you paid to use the Service during the 12-month period prior to your claim.

6.3 Third-Party Content

We are not responsible for the actions, accuracy, or communications of colleges, advertisers, or other third parties you interact with through the Service.

7. Indemnification

You agree to indemnify and hold harmless FindU, its directors, officers, employees, contractors, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including legal fees) resulting from:

  • Your use of the Service
  • Your violation of these Terms
  • Any content or actions that cause harm to another party

8. Termination

8.1 Termination by You

You may delete your account at any time using the in-app account deletion feature.

Upon deletion, your profile will be removed from active databases; however, data already shared with partners may persist under their independent control. It may take up to 30 days to fully process.

8.2 Termination by FindU

We reserve the right to suspend or terminate your access to the Service immediately if you violate these Terms or pose a security or legal risk to us or other users.

8.3 Effect of Termination

Termination of your account will not affect any rights or obligations accrued prior to termination. Provisions regarding intellectual property, disclaimers, indemnification, and governing law will continue to apply.

9. Governing Law and Dispute Resolution

9.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Nebraska, USA, without regard to its conflict of laws provisions.

9.2 Dispute Resolution

All disputes arising from or related to these Terms or the Service will be resolved through individual binding arbitration in Lancaster County, Nebraska, in accordance with the rules of the American Arbitration Association.

You agree to waive your right to participate in class actions.

Either party may seek injunctive relief in court to prevent irreparable harm.

10. Miscellaneous

10.1 Entire Agreement

These Terms and our Privacy Policy constitute the full agreement between you and FindU and supersede any prior agreements.

10.2 Severability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect.

10.3 No Waiver

Failure by FindU to enforce any part of these Terms does not constitute a waiver of our right to enforce them later.

10.4 Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights at any time as part of a corporate transaction or business continuity event.

10.5 Force Majeure

FindU is not responsible for failure or delay in performance due to events beyond our control, such as natural disasters, war, acts of government, or internet outages.

10.6 Notices

We may send you notices via email, in-app notifications, or mail. Notices will be deemed delivered once sent to your last known contact information.
